Warranty Update

On May 29th, 2024, Florida Governor Ron DeSantis signed legislation into law making important changes to HVAC manufacturer warranties. The legislation prohibits the conditioning of a manufacturer’s warranty on product registration if the HVAC equipment is installed by a contractor licensed by the Florida Department of Business and Professional.

Regulation

The law requires warranty conveyance/transferability upon sale of the home, regardless of product registration, but does not extend any existing product warranty terms.

Additionally, manufacturers will be required to include in product registration materials an explicit statement that failure to register a product does not diminish any warranty rights nor decrease the warranty length. The law is effective on real property conveyances on or after July 1, 2024.
